Applicability and Conditions

  1. Our general conditions apply to every offer from us as a webshop to you as a Consumer (any natural person exclusively purchasing or using a good or service offered on the market for non-professional purposes).
  2. We deliver exclusively in Belgium and the Netherlands. If you provide a delivery address outside this country, we reserve the right to refuse your order.
  3. To place an order, you must be over 18 years old. If you are under 18, we ask you to have your order placed by a parent or guardian. If we become aware that an order has been placed by a minor, we reserve the right to refuse your order.
  4. Placing an online order on the website signifies formal acceptance of our general conditions, always available on our website.
  5. If you order online, we will provide you, along with the order confirmation or at the latest upon delivery, a copy of these conditions in a format you can save or print. We recommend doing so.
  6. If additional specific conditions apply alongside these conditions, the above also applies to those specific conditions. As a consumer, you can always invoke the most favorable text if our conditions conflict with the specific conditions.

 

Our Offer and Your Order

  1. If an offer is valid for a limited period or subject to specific conditions, we expressly mention it in our offer.
  2. We always describe as fully and accurately as possible what we are selling to you, as well as the course of our delivery process. The description is always sufficiently detailed for a proper assessment. If we use images, they are a truthful representation of the offered goods and/or services. However, mistakes can happen, and if we clearly make an error, we are not obliged to deliver to you.
  3. Your order is completed, and the contract between us is final once we have confirmed your order by post and, regarding your payment by credit card or debit card, once we have received approval from your card issuer. We accept Visa, Mastercard, Maestro, Bancontact, iDeal. If your card issuer refuses to approve your payment to us, we cannot be held responsible for any delays in delivery and/or non-delivery of your order. Orders without a valid payment in the name of the registered cardholder will not be accepted or processed.
  4. To purchase a product, add it to your shopping cart. Then provide your contact and billing information. Next, choose your preferred delivery method: delivery to a specific address. In the final step, you will reach a summary page, accept our general conditions, and confirm your payment by clicking the ‘Confirm’ button. Once you have completed these steps, your purchase is final.

 

Right of Withdrawal

  1. When you purchase goods from us, you have the right to decide not to keep the goods within 14 days from delivery or the conclusion of the contract. You can return your order without penalty and without giving a reason (the costs are at your own expense). Within 14 days of receiving your returned order or your notification that you want to cancel the agreement, we will refund the full purchase amount to you using the same payment method you used for the purchase. However, we can only do this if the item is returned in its original condition and undamaged in the original packaging. EXCEPTION: Custom items, made specifically for you, are not returnable in any case.
  2. The direct costs of returning the goods are therefore at your expense. We will indicate the return costs or provide an estimate of the costs if it is not reasonably possible to calculate them in advance.
  3. We may refuse a refund until we have received the returned goods in their original condition.
  4. We expect you to handle the order and packaging with the utmost care during the first 14 days after delivery. If you want to return the goods as described above, you may only unpack or use them to the extent necessary to assess whether you want to keep them. Returned goods can be tested but not used.

 

Price

  1. If we mention a period in our offer, our prices do not change, except for price changes due to changes in VAT rates.
  2. Our prices include all taxes, VAT, and any other levies. Shipping costs are calculated separately.

 

Payment

  1. We only accept prepayments through our website using the specified payment methods.
  2. To ensure secure online payment and the safety of your personal data, transaction details are transmitted only while encrypted with SSL technology. No special software is required to make payments with SSL. You can recognize a secure SSL connection by the “lock” in your browser.

 

Conformity and Warranty

We guarantee that our products conform to your order and meet the normal expectations you may have, taking into account the product specifications. We also guarantee that our goods comply with Belgian legislation applicable at the time of your order.

You have the legal warranty protection for 2 years. To invoke the warranty, the defect in the product must:

  • Exist at the time of delivery, and
  • Occur within a period of two years from the delivery.

To invoke the warranty, there must be:

  • A lack of conformity between the requested and delivered product, and
  • The defect must be present at the time of delivery, and
  • The defect must occur within a period of two years from delivery.

The legal warranty will not apply when:

  • The damage is caused by normal wear and tear;
  • You have made changes to the products;
  • The damage is caused by incorrect use.

The warranty includes free repair or replacement of the defective product. If this is not possible, we may opt for a proportional price reduction or the dissolution of the sale. In the latter case, you will receive a full refund, and the product must be returned.

Important: Any shortcomings in our products must be reported within two months of discovery.

 

Delivery and Execution

  1. All goods and services are delivered to the address you provided when ordering.
  2. When an item is in stock, it will be delivered to the delivery address in Belgium within 5 working days. For other countries, delivery may take longer.
  3. If we cannot deliver on time, we will inform you before the end of the expected delivery time. If we do not do this, you can cancel your order for free. EXCEPTION: Custom, made-to-order, orders cannot be canceled in any case. In that case, we will refund you within 30 days of the agreement’s dissolution.
  4. The shipment of goods and gift vouchers is always at our risk. Therefore, you do not have to worry about lost goods during transport. However, if you return the goods within 14 days of delivery because you prefer not to keep them, you are responsible for the transport.
  5. If the delivered goods are damaged during transport, do not match the goods listed on the delivery note, or do not match the goods you ordered, you must report this as soon as possible and, in any case, within the period specified under the warranty terms. You must then return the goods within 14 calendar days of delivery.
  6. We cannot be held responsible for any consequential damages resulting from late delivery or non-delivery by the company’s designated carrier. In such cases our liability is limited to the value of the goods which are proven not to have been received by the customer.

 

Force majeur

  1. In the event of force majeure, we are not obliged to fulfill our obligations. In that case, we can either suspend our obligations for the duration of the force majeure or definitively terminate the agreement.
  2. Cases of force majeure are all circumstances beyond our will and control that make it completely or partially impossible to fulfill our obligations. Such events include strikes, fire, disruption of the energy supply or telecommunications networks or communication systems and/or the temporary outage of the webshop, late delivery or non-delivery by suppliers or other third parties.

 

Intellectual property

  1. Our website, logos, texts, photos, names and in general all our communications are protected by intellectual property rights belonging to us or our suppliers or other rights holders.
  2. It is prohibited to use and/or modify the intellectual property rights described in this article. You may therefore not copy or reproduce drawings, photos, names, texts, logos, color combinations, etc. without our prior written and express permission.

 

Complaints procedure and conflicts

  1. We hope that all our customers are always 100% satisfied. If you nevertheless have any complaints about our services, please feel free to contact us via EMAIL. We will do our utmost to handle your complaint within 7 days.
  2. All agreements that we conclude with our customers, regardless of their place of residence, are governed exclusively by Belgian law. Only the courts of Belgium have jurisdiction to rule on disputes arising from or related to these contracts. If, as a result of international law, the law of another country applies, the interpretation of the current terms and conditions will primarily be done in accordance with the Belgian Market Practices and Consumer Protection Act.
  3. The European Union also has an  Online Dispute Platform (ODR – Online Dispute Resolution)  where you can always resolve a dispute outside of court.
